          Under and by virtue of a Deed of Trust dated the 13th day of September 2019 and recorded in Liber No. 7497, folio 116, among the Land Records of Worcester County, Maryland, default having occurred under the terms thereof and at the request of the party secured thereby, the undersigned Substitute Trustee will sell at public auction, at the Circuit Court House Steps, One West Market Street, Snow Hill Maryland 21863 on:

 

JULY 12, 2022 AT 2:30 P.M.

 

            ALL that lot or parcel of land lying on the westerly side of the county road leading from Stephen Decatur High School to Trappe, in the Third Election District of Worcester County, Maryland, more particularly described as follows:

BEGINNING at a concrete monument set on the Westerly side of the said dirt road mentioned in Parcel No. One, in Item No. one, hereinbefore described, said concrete monument being next to an iron oak three (3) feet in diameter, said concrete monument being North 4 degrees 57 minutes 16 seconds West 203.17 feet from the end of the third line of the property mentioned in Parcel No. One hereof; thence running by and with the Southerly line of the property granted and conveyed to Raymond J. Davis and Elizabeth C. Davis, his wife, by Rhonda E. Prideaux, et al. (dated March 9, 1939 and recorded among the Land Records of Worcester County, Maryland, in Liber BB No. 37, folios 546 and 547), North 88 degrees 01 minutes 30 seconds West plus or minus 279.73 feet across a concrete monument set on the line to Trappe Mill Pond Branch; thence by and with the said Trapp Mill Pond bank in a Southerly direction to the intersection with a line described as follows: BEGINNING for the first mentioned monument for the property described in this, the second, item hereof, thence South 3 degrees 27 minutes West 1,106.91 feet to a concrete monument set on the Westerly side  of  the aforementioned dirt road; thence North 86 degrees 39 minutes 30 seconds West plus or minus 660 feet to the Trappe Mill Pond Branch, this last described line passing through a large pine of 1.5 feet in diameter with the monument on the West of said pine and four (4) feet from its center; and from said point of intersection with the last described line by and with the Northerly line of the property granted and conveyed to Mack Smith and Elsie Smith, his wife, by Esther A. Davis, widow, (by deed dated July 17, 1947, and recorded among the Land Records of Worcester County, Maryland in Liber CWN No. 16, folios 408 and 409), South 86 degrees 39 minutes 30 seconds East plus or minus 660 feet to a concrete monument set on the Westerly side of the aforesaid dirt road, said concrete monument being indicated on the Plat attached hereto by letter "E"; thence by and with  the  Westerly  side of the aforesaid  dirt road  North  3 degrees  27 minus  East 1106.91 feet to the place of beginning, as surveyed during the month of November 1948, by George B. Cropper, Registered Engineer and Surveyor No. 248, with magnetic bearings as of November, 1948;

EXCEPTING, HOWEVER, all those lots or parcels of land as shown on the plat known as "Subdivision of a Portion of Lands of The Adkins Company", made by George B. Cropper, Registered Surveyor, in August 1963, and recorded among the Land Records of Worcester County, Maryland, in Plat Book FWH No. 2, folio 41, and more particularly described as follows: 1) Lot No. One (1) as shown on said plat and conveyed by the Adkins Company to Anna Ella Hall by Deed dated January 29, 1965 and recorded among the aforesaid Land Records in Liber No. 184, folio 153, et seq.; 2) Lot No. Two (2) as shown on said plat and conveyed by the Adkins Company to James S. Leonard by Deed dated June 10, 1968 and recorded among the aforesaid Land Records in Liber No. 233, folio 556, et seq.; 3) Lot Nos. Three (3), Four (4), Five (5), and Six (6) as shown on said plat and conveyed by the Adkins Company to Owens Fontaine Purnell and Mildred Gertrude Purnell by deed dated January 25, 1964 and recorded among the aforesaid Land Records in Liber No. 178, folio 425, et seq.; 4) Lot No. Seven (7) as shown on said Plat and conveyed by the Adkins Company to Henry Louis Brittingham by Deed dated July 13, 1965 and recorded among the aforesaid Land Records in Liber No. 187, folio 421 , et seq.; and 5) Lot No. Eight (8) as shown on said plat and conveyed by the  Adkins Company to Mildred Showell Bowen by Deed dated November 2, 1966 and recorded among the aforesaid Land Records in Liber No. 216, folio 326, et seq.

AND EXCEPTING, FURTHER, ALL that property described in a deed conveyed by the Adkins Company to Sidney Fisher, J r. and Esther Rebecca Davis Fisher, dated November 25, 1967, and recorded among the aforesaid Land Records in Liber No. 226, folio 514, et seq.

BEING the same property conveyed unto James Christopher Dodge from Harold R. Macket, Sr., by Deed dated September 13, 2019, and recorded among the Land Records of the Worcester County, Maryland, in Liber S.R.B. No.  7497, Folio 110.

            The property will be sold in "AS IS" condition, subject to any existing building violations, environmental hazards, etc. and also subject to conditions, restrictions and agreements of record affecting same, if any. Neither the Substituted Trustees nor their respective agents, successors or assigns make any representations or warranties, either expressed or implied with respect to the property including without limitations, description, use, recorded or unrecorded leases or other occupancy agreements, if any, operating and management agreements, physical conditions or to the environmental conditions of the subject property. The Substituted Trustees shall be required to convey insurable title.

   TERMS OF SALE:  The required deposit, in cash or certified check is $20,000.00 at the time and place of sale, balance in cash, immediately within twenty (20) days after the final ratification of the sale by the Circuit Court for Worcester County, time being of the essence, and to bear interest at the rate of 8.000% per annum from the date of sale to date of settlement. In the event the above-named Holder of the indebtedness purchases the property at the sale as the high bidder, no deposit will be required and the requirement of interest on the balance of the purchase price shall be waived. In the event settlement is delayed for any reason, there shall be no abatement of interest. If the purchaser defaults, in addition to all other remedies including but not limited to attorney fees, the Substituted Trustees may declare the entire deposit forfeited and resell the property at the risk and expense of the defaulting purchaser. The defaulting purchaser shall be liable for the payment of any deficiency in the purchase price, all costs and expenses of the sale, attorney fees and all other charges due and incidental and consequential damages. Taxes shall be prorated as of the date of sale. All other public charges and assessments payable on an annual basis, including sanitary and/or metropolitan district charges to be adjusted for the current year to date of sale and assumed thereafter by the purchaser. Cost of all documentary stamps and transfer taxes shall be borne by the purchaser. Assessment of Agricultural Transfer Tax shall be the sole responsibility of purchaser. Purchaser shall have the responsibility of obtaining possession of the property. In the event the Substituted Trustees do not convey title for any reason, purchaser’s sole remedy is return of deposit. The Substituted Trustees shall have the right to terminate this contract in the event the holder has entered into any agreement with or accepted funds from or on the behalf of the mortgagor. Upon termination of the contract, Purchaser’s sole remedy shall be return of the deposit.
